1. Acceptance of Terms
By accessing, registering on, or using the Van-MY platform ("Platform"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, you must not use the Platform.
These Terms constitute a legally binding agreement between you and Van-MY.
2. Platform Description
Van-MY operates an online peer-to-peer marketplace that enables camper van owners ("Hosts") to list vehicles for rental and individuals ("Renters") to book those vehicles.
Van-MY:
- Does not own, operate, manage, or inspect vehicles listed on the Platform
- Is not a party to the rental agreement between Host and Renter
- Acts solely as a facilitator of bookings, communication, and payments
All rental agreements are entered into directly between Hosts and Renters.
3. Eligibility and User Accounts
To use the Platform, you must:
- Be at least 18 years of age
- Hold a valid driving licence recognised in Malaysia (including international license when applicable)
- Provide accurate, complete, and current information during registration
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.
Van-MY reserves the right to refuse registration or suspend accounts at its discretion.
4. User Responsibilities
4.1 Responsibilities of Renters
Renters agree to:
- Provide accurate personal, driving, and payment information
- Use the vehicle lawfully and responsibly
- Comply with all applicable traffic laws and regulations
- Return the vehicle in the same condition as received, subject to normal wear and tear
- Report any accident, damage, malfunction, or incident immediately
- Not allow unauthorised drivers to operate the vehicle
4.2 Responsibilities of Hosts
Hosts agree to:
- Ensure vehicles are roadworthy, safe, and legally registered
- Provide accurate vehicle descriptions, images, and availability
- Maintain valid insurance as required under Malaysian law
- Disclose any material defects or limitations
- Respond to booking requests and inquiries in a timely manner
5. Bookings, Payments, and Deposits
All bookings are subject to Host acceptance.
Payments are processed via third-party payment service providers. Van-MY does not store full payment card details.
A security deposit may be required and held for the duration of the rental. Deposits are typically released within 7 days after vehicle return, subject to:
- Damage claims
- Traffic violations
- Outstanding charges
Cancellation policies vary by listing and are disclosed prior to booking confirmation.
6. Insurance and Liability
Hosts are responsible for ensuring that their vehicles are insured in accordance with Malaysian law.
Optional insurance coverage may be offered through the Platform or third-party partners. Coverage terms vary and must be reviewed by users before booking.
To the maximum extent permitted by law:
- Renters are responsible for all fines, damages, losses, or claims arising during the rental period
- Van-MY is not liable for accidents, injuries, death, property damage, or losses related to vehicle use
- Van-MY does not guarantee vehicle condition, suitability, or availability
7. Prohibited Activities
Users must not:
- Use vehicles for illegal or unlawful purposes
- Operate vehicles under the influence of alcohol, drugs, or medication impairing driving ability
- Sublet, lend, or commercially exploit vehicles without Host consent
- Exceed vehicle capacity, load, or towing limits
- Engage in off-road driving unless expressly permitted
- Provide false information or engage in fraudulent behaviour
Violation of this section may result in immediate account suspension or termination.
8. Disputes Between Users
Van-MY may assist in facilitating communication between Hosts and Renters but does not guarantee dispute resolution.
All disputes relating to damages, payments, or rental issues must be reported within 48 hours after rental completion.
Users remain primarily responsible for resolving disputes directly with each other.
9. Platform Availability and Modifications
Van-MY may modify, suspend, or discontinue any part of the Platform at any time without liability.
Van-MY may update these Terms periodically. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
10. Account Suspension and Termination
Van-MY reserves the right to suspend or terminate accounts that:
- Violate these Terms
- Engage in fraudulent, unsafe, or harmful conduct
- Expose the Platform or other users to legal or reputational risk
Users may request account deletion at any time, subject to legal and regulatory obligations.
11. Limitation of Liability
To the fullest extent permitted by law, Van-MY shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profit, data, or business opportunity
- Acts or omissions of Hosts, Renters, or third parties
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Malaysia.
Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the Malaysian courts.
